% e2 W' _7 q* F: U7 D* ? 大连沙河口区法院介绍，今年3月22日上午，于先生在沙河口区某彩票投注站帮朋友赵某买彩票。21时24分，投注站老板刘某为赵某打出了一张128元的复式彩票。于先生觉得“有戏”，眼看要封机了，他让刘某按这张彩票给自己也打一张。21时27分，彩票站为于先生出了彩票。翌日，赵某选的号中奖了，可于先生去投注站询问兑奖事宜时发现，他的彩票没中奖。* X8 S6 J3 W' @
刘某承认是自己打错票了，同意赔偿于先生购买彩票的4000元，但条件是：于先生今后在该投注站购买5万元的彩票。于先生一气之下将刘某告上法庭。
" H% ~. o- E6 s- ]. s) q0 S4 @5 W0 i 沙河口区人民法院审理后认为，原告在被告处买彩票，被告给原告打彩票，双方之间形成合同。但因被告打错彩票，导致原告未中奖，被告的行为构成违约。关于被告提出于先生未尽核对义务，法院认为，当时时间紧，即使原告当时发现打错也无办法更改。近日，沙河口区人民法院一审判决：刘某赔偿于先生购买彩票款128元，并赔偿其经济损失3000元。据了解，这是首宗因打错票而上诉法庭的彩票案件。 |
