另一方面，根据香港信报报导，当前律师对于JPEX受害者的处境并不乐观，金融市场监管及虚拟资产领域律师陈8 E4 x) i0 p( a) q7 H
廷谦在受访时表示：目前的难处是未掌握客户资产是由JPEX哪个法律实体持有，亦不知该法律实体注册地，现阶' C- P$ N5 D' j# u) Y: [1 N$ l
段香港用户若考虑民事索偿会有一定困难。
! z% R7 Z' M8 `; G' i不过，陈廷谦指出除了公司外，若有足够证据显示有人涉违法或违约等行为，视乎相关证据和案件情况，也有可6 A9 ~7 U! T& M6 s" J9 Z! L A
能向这些人士提出民事索偿。

- @$ v- Y4 r& v) S) V此外陈廷谦提到，一旦JPEX倒闭，若参考过往在港注册的无牌虚产交易平台Gatecoin清算程序，过程须把平台资/ l* m. T! J! ?) e: L `
产有序分配给债权人，用户的债权人类型很大程度取决于平台和用户之间的条款。
