辽宁58亿元网络Dubo案首犯被判刑15年
9 \/ ^2 |* K8 G1 I& x辽宁省抚顺市顺城区人民法院近日分批对一涉案额５８亿元的特大网络Dubo案公开宣判，首犯杨旭一审被判处有期徒刑１５年，并处没收财产２０００万元，罚金人民币２０００万元。其余４１名被告人分别被判处有期徒刑、缓刑、罚金等刑罚，全案罚没总金额达到１． ５亿多元。8 a, \# r$ S7 o( \4 I
这是近年来辽宁省查办的最大一起Dubo案。２００７年１月１６日，辽宁省公安厅接到群众举报称，沈阳地区出现一个以杨旭为首的网络Dubo犯罪团伙，非法牟取暴利。警方随后展开侦破工作，初步发现案件涉及１００多人，多是母子、兄弟、同事、夫妻一起牵涉其中。
3 T' o( y4 r) k" N& J& b. d检察机关经审查，对涉案的１００多人中的４２人依法分批提起公诉。２００７年９月２０日，法院第一次开庭审理此案。
7 G3 P9 R0 d8 y5 i法院审理查明，２００５年１１月，被告人杨旭和妻子王军纠集王旭、郭杰等人成立电脑网络Dubo团伙，吸引下线投注赌球、赌6HC。杨旭是团伙的领导者和管理者，并负责提供Dubo网站账号和密码，王军负责提供赌资和团伙成员的工资发放。建立“组织机构”后，杨旭等人在“东方2”、“大联盟”等Dubo网站开设娱乐城，并逐步发展总代理商、代理商、会员等下线。短短两年，以杨旭、王军夫妻为首的网络Dubo犯罪团伙扩充到１００余人，涉案赌金高达５８亿元。
Y6 N; {" n% T由于涉案人数众多，抚顺市顺城区人民法院采取分批宣判的办法，于２００８年６月２６日第一批共宣判首犯杨旭等２８人，６月３０日第二批宣判蔺东辉等８人，７月２日第三批宣判董春野等６人。
6 s% U+ V- @* H0 `1 h! a- ?法院认为，被告人杨旭在这起特大Dubo案中，明显处于主要地位，为主犯，其行为构成非法经营罪，判处有期徒刑９年；犯开设娱乐城罪，判处有期徒刑８年。数罪并罚，法院决定对杨旭执行有期徒刑１５年。其余被告人也均因犯非法经营罪、开设娱乐城罪，被定罪量刑。3 s& M, L" Q3 P" q+ k
据悉，该案被告被判定没收财产最高的达到２０００万元，最低的也有１００万元，罚金最多的２０００万元，最少的５万元。所有被告人均被依法没收涉案赌资、犯罪所得和犯罪工具。 |
